Employee Is Struck on Head by Falling Panels

At approximately 12:00 PM on September 24, 2009, an employee, age 36, was working to install sections of the concrete form work panels for the basement foundation walls of a house. The form work was in sections, stacked on shelving units. The shelving units were located in the interior section of the basement where the employee was working on the outside bank of the excavation, approximately 5 feet above the employee. The foundation walls were 9 feet tall plus or minus 4 inches. The employee was working at the front wall to set the panels in place. Other employees were working at other sections to set the panels. This was the first day at the job site. The shelving unit with the forms fell and struck the employee in the head. He was transported by ambulance to a hospital and received stitches for a laceration to his head. He also suffered a concussion and was hospitalized for two days. The shelving unit was approximately 9 feet tall, 2 feet deep (wide), and 3 feet 4 inches long across the front. Approximately 40 panels fell on top of the employee. Each panel was 2 feet by 3 feet and 2 inches thick. The total weight of the panels and shelving was approximately 800 to 1,000 pounds. The shelving units were located on the dirt ground of the foundation and were not level. The ground was not flat and had different levels ranging up to 4 inches in height. The employees were exposed to the hazard of being struck by the concrete form panels due to them not being staged on a level surface. The employees did not wear a protective hard hat. The employee has worked for the company for six years and does have training in the 30 hour OSHA Construction course.
