Employee injured when struck by vehicle on highway

On January 8, 2007, Employee #1, of McKenna General Engineering, Inc., was working as a flagman at a jobsite when he was struck by a vehicle on a highway in Perris, CA. According to his attorney, two years later Employee #1 underwent surgery related to the injury sustained in the accident and was hospitalized for more than 24 hours. On November 30, 2009, DOSH opened an investigation to determine, among other issues, whether the employer failed to comply with T8CCR 342a, concerning requirements to report serious injuries.
