Investigation Summary

At approximately 12:48 p.m. on August. 28, 2012, Employee #1, a 33-year-old male paving worker with Security Paving Inc., was cleaning concrete from the paving machine trough when a dump truck driven by a worker of another Employer backed up pinning Employee #1 between the dump box and the trough of the paving machine. Employee #1 sustained a bilateral fracture to his pelvis. Employee #1 was standing on the concrete surface of the new West-side parkway project at the westbound on ramp to the parkway from Calloway Drive. The dump truck was a Kenworth three-axle 10-12 yard dump truck, serial number: 1XKWD69X2RR620833, plate number: 7X46770, and the paving machine was a Gomaco Model 9,500, serial number: 905500-168. The width of the trough was one hundred and thirty one inches and a height from the ground to the top of the trough was approximately thirty-six inches. The causal factors were that the dump truck driver did not exit his truck to verify that all equipment and personnel were clear from behind the dump truck prior to backing the dump truck to the paving machine to unload the concrete in the dump truck box. The Employer was a general engineering contractor on the Westside Parkway project for the City of Bakersfield and the State of California. Employee #1 was a permanent full time employee of the Employer.
