Investigation Summary
Metro Commercial Construction is an incorporated company, a licensed contractor verbally contracted to remove some planters from an elevated ledge on an outside wall of the Glendale Galleria. At the time of the accident, the employees were determined to have been using a scissors lift to access the planters and remove material from inside the planters to lighten them so the planters could be later removed. All three employees were determined to have been working inside the platform attempting to shovel dirt into a trashcan located on the platform with the three employees. While the employees were shoveling the dirt out of one of the planter, the planter shifted and struck the scissors lift causing it to tipped over. According to the witnesses, one of the employee attempted to jump off the lift while the other two employees rode with the lift down. All three employees were seriously injured and were transported to hospital for treatment. The foreman of the trio was determined decease two days after the accident. The Division has determined the accident was caused by the employer not following the manufacturer's operating instructions by allowing more than one employee to work inside the platform. It was also determined the employer had fully extended the lift exceeding the maximum platform height recommended on the operating instructions. A serious citation in relation to this accident will be issued to the employer as the result of this investigation.
