Employee Is Injured in Fall from Scaffold

At 1:30 p.m. on April 27, 2010, Employee #1 was performing his duties of drywall installer with American Theatrical Drywall and Framing Inc dba American Theatrical Construction. Employee #1 was on the east side of the site installing drywall above a doorway from a rolling scaffold that measured slightly less than seven feet six inches to the working platform. Just before the incident occurred, Employee #1 left to use the restroom. When he returned, the scaffold had been moved slightly from its previous position but was still in position for him to continue work. Employee #1 stated that he did not know who had moved the scaffold. After climbing to the working platform, Employee #1 began to caulk the installed drywall when he leaned against the wall causing the scaffold to move away and him to fall to the concrete floor below. The wheels of the rolling scaffold were not locked at the time of the incident. Employee #1 stated that he did not think to check the scaffold wheels because they had been locked before he left to use the restroom and had always been locked when the scaffold had been moved on prior occasions. Cal/OSHA determined that the accident was caused by the wheels of the scaffold not being locked prior to Employee #1 commencing work from the scaffold. Cal/OSHA received a report of the industrial incident on April 27, 2010. At 1:20 p.m. on May 4, 2010 the investigator arrived onsite and conducted an opening conference with the project administrator at the site. A subsequent opening conference was held at 1:55 p.m. with Augustin Lopez vice president of American Theatrical Construction.
