Investigation Summary
On May 16, 2009, Employee #1 was working as a carpenter apprentice for the Hathaway Dinwiddie Construction Company, which was involved in commercial construction. He had worked for them for three years and nine months. He was performing his regularly assigned work. He was using a Model Number H96119 Skilsaw MAG HD77M, with Serial Number HF338940, to cut wood for use as spreaders for concrete forming. At the time of the accident, he was ripping a 2-inch by 4-inch by 10-inch piece of wood for 10-inch forming. He was holding the piece of wood with his left hand while he cut it with the circular saw. As Employee #1 was halfway through the cut, the saw kicked back. He did not have enough time to remove his left hand, and the third finger on his left hand was amputated. He was transported by ambulance to Huntington Memorial Hospital, where he was treated for the amputation and released the same day. The employer stated that it was against company policy for a worker to hold a piece of wood with his hands while ripping it with a circular saw. The Employer submitted training documents indicating that Employee #1 had been trained in general safety.
