Employee's Back and Rib Are Fractured in Fall from Ladder

On November 22, 2009, Employee #1, a farm worker employed by Frank Rivera Farm Labor Contractor, was part of a crew assigned to harvest olives in an orchard. He and a coworker were using poles to knock olives off the trees, and they had set up at least one ladder by the tree. A tarp had been spread on the ground underneath the tree to catch the olives. Employee #1 climbed a 14-foot ladder to aid him in knocking olives off the tree. While he was near the top of the ladder, he fell to the ground and landed on his back. A coworker notified the employer, who reached the site soon thereafter and transported Employee #1 to the hospital. He was hospitalized with a fracture of the dorsal and lumbar vertebra (T12 compression fracture), a fractured rib, and contusions. He was released from the hospital on November 26, 2009.
