Investigation Summary
On July 13, 2009, Employee #1, a farm worker with Reyes FLC, was working in a pear orchard as part of a picking crew. When the crew finished harvesting fruit in one part of the orchard they were told to move to another section and to put the ladders they were using onto the top of bins that were on a bin trailer being pulled by a tractor. The ladders were stacked high and Employee #1 was riding on the step board of the bin trailer when several ladders fell off and struck him. A supervisor who did not witness the accident disputed the account and the tractor driver who was interviewed also dismissed that account. The tractor driver who did not actually see the accident claimed that Employee #1 was wearing a flexible picking basket that went around his neck and he ducked while on the bin trailer to get out of the way of low hanging branches. As Employee #1 ducked, the picking basket got caught up in the wheel of the trailer and jerked his head towards the step board. Inspector was unable to locate other witnesses to help clarify what really occurred. Emergency personnel responded and the victim was airlifted to UC Davis Medical Center in Sacramento. He sustained fractures to three ribs on his left side and a possible fracture to his hip (left side) and was released from the hospital four days later.
