Employee's Spine Is Fractured When Struck by Loader Bucket

At approximately 6:00 p.m. on March 18, 2009, Employee #1 and a coworker, laborers, were clearing scrap metal and other materials from a vacant lot and an adjacent two story building. The cleared materials were being sorted into metal refuse containers. A John Deere, Model Number 710C, backhoe loader, Serial Number T1710CD755562, was being operated by the employer. Employee #1 was reaching to retrieve a piece of metal and was struck on the right shoulder by the bucket. He was pinned to the ground, fracturing his lumbar spine. Employee #1 was hospitalized.
