Employee Dies from Atv Roll-Over

On July 6, 2009, Employee #1, of Landfill Operators Inc, was operating a 4-wheel all terrain vehicle (ATV), Yamaha Model No. YFM40FP(C), in order to transport some water hoses from his home storage shed to his job site, a nonhazardous landfill located approximately one mile from his home. Employee #1 secured the hoses to a clip-type carrier on the back of the ATV and the drove to the landfill, where he hooked up the hose and then got back on the ATV in preparation to leave the job site. His coworker, who was approximately 8-to-10 feet from Employee #1, heard him give the ATV some throttle and saw the right rear wheel come several inches off the ground. He then saw Employee #1 "jump" from the ATV and end up on the ground with the ATV on top of him, but right side up. The employee's legs and torso were beneath the ATV body, but not directly under the tires. The coworker picked up the rear end of the ATV, and Employee #1 crawled out. Employee #1 declined assistance and drove home from the job site. Employee #1 received medical treatment for injuries related to the accident later that night at a local hospital. On July 15, 2009, Employee #1 collapsed at home and was taken to a local Ottawa hospital, and then transported to a Peoria hospital, where he died at 1:55 p.m. The Peoria County Coroner determined that the employee's death was caused by medical complications following injury to Employee #1's leg during the ATV accident.
