Investigation Summary

On March 30, 2009, Employee #1, the owner of tiling company, was loading his flatbed truck with equipment in preparation for the following days work. The equipment was located at a facility that Employee #1 rented. While Employee #1 was either loading an all-terrain forklift onto the truck or using the forklift to load materials onto the truck, he was run over and killed by the all-terrain vehicle. The next morning, at 5:00 a.m., a worker found the all-terrain forklift running. He turned off the motor, but did not see Employee #1. The worker then called Employee #1's business and left a message, explaining that he had found the equipment running and that he shut it off. Approximately two hours later (7:00 a.m.), one of Employee #1's workers arrived to pick up the equipment and drive to the jobsite. The worker discovered Employee #1 dead, pinned underneath its passenger-side wheels of the forklift. In addition, its transmission was in neutral, and without the parking brake set. The Coroner's report determined that Employee #1 died from massive traumatic head injuries, when he was run over by the forklift.
