Employee Amputates Fingers While Using Table Saw

At approximately 10:26 a.m. on May 8, 2009, Employee #1 was using a 10-in. Ryobi portable table saw (Model Number BTS10, Serial Number XX040328058) to cut wood flooring pieces (3-in. wide, 2-ft long, and 0.5-in. thick) for a wooden floor being installed at residential home. The table saw blade guard and riving knife assembly was missing prior to the accident happening. The guard had been missing the last eight months, the entire time Employee #1 was employed by the company. Employee #1 was cutting the flooring piece with the grain (rip cut) by making two cuts to the same piece of wood. Employee #1 finished the first cut and was starting to make the second cut by pushing the piece of wood with his right hand towards the blade. The blade fell down and then popped back up, causing the blade to pull the wood piece forward, making Employee #1's right hand come into contact with the moving table saw blade. Employee #1 sustained a complete amputation of his right thumb, right index finger, right long finger, and traumatic wounds to his right ring finger. Employee #1 was hospitalized.
