Investigation Summary
At approximately 12:10 a.m. on November 6, 2010, Employee #1, who was employed by Platinum Staffing, Inc., a temporary help agency, was working at the production department of a facility owned by Organic Milling Acquisitions, LLC, in San Dimas, California. Under their new name, the onsite employer had manufactured breakfast foods, such as cereals, for approximately three years and employed approximately 100 employees on inspection day. Employee #1, who had worked for 2.5 months as a general worker, opened the top cover of a horizontal food mixer and cleaned the inside with a spatula. As he was doing this task, the spatula fell inside. When Employee #1 tried to remove the spatula with his left hand, his left thumb contacted the moving auger inside the mixer and was partially amputated. Employee #1 was initially taken to Pomona Valley Hospital and was later transferred to Loma Linda University Hospital, where he received medical treatment and was hospitalized for three nights. The onsite employer reported the accident to Cal/OSHA approximately 58 hours after it happened, instead of 8 hours, as required by regulation. The 220-volt horizontal food mixer was running at the time of the accident because power to mixer was not disconnected. During the inspection, the employer's safety manager stated that the cover on the mixer had an interlock device, which deenergized the mixer, as soon as the cover was opened from its sitting position. However, Employee #1 moved the cover partially to one side and bypassed the interlock device for his convenience. Employee #1 could not be interviewed about the accident. Investigations revealed that the interlock device was not arranged so that it would deenergize the mixer as soon as the cover was lifted or moved to any side from its original sitting position. The onsite employer was cited for an inadequate and ineffective interlock device on the horizontal food mixer and was also cited for late notification of this accident to Cal/OSHA.
