Employee Is Struck and Killed by Yard Truck

At approximately 5:20 a.m. on February 12, 2009, Employee #1, a temporary employee working for Transforce Staffing, had just finished his shift and was preparing to go to his private automobile to warm up the engine. He first went to remove keys from his yard truck that he had been previously operating, when he was struck and killed by another yard truck that was making a u-turn and was maneuvering to pick up a load. Further investigation revealed that the employer, NYK Logistics, had not trained employees that operated the yard trucks on the safety requirements for powered industrial trucks nor were their safety rules documented and communicated to operators who were temporary employees. In addition, warning devices were not in use on a consistent basis.
