Investigation Summary
Employee #1 stood on a platform that was elevated approximately 10.5-ft by a Caterpillar Model Number IT24F front end loader with fork tine attachments. There were slots under the platform into which the forks fitted. The guard rails of the platform were not on all four sides, the top rail was only 34.75-in. high, and there was no mid-rail. Employee #1 did not have on a body belt or harness with a lanyard attached to the platform or boom of the front end loader. Employee #1 was elevated so that he was able to observe scrap metal being dumped into a tractor trailer bed. Employee #1 was positioned in close proximity of the tractor trailer bed. The dumping process consisted of the scrap being placed in a number of dump truck beds that had been removed from the trucks. An American lattice boom crawler crane (Model Number 4250) would lift a dump truck bed, tilt it, and dump its contents into a skip pan which, in turn, would be lifted by the crane, tilted, and its contents dumped into the tractor trailer bed. The skip pan was used because the dump truck beds would not fit into the tractor trailer bed. At the time of the accident, the crane was tilting an elevated dump truck bed to dump its contents into the skip pan. Instead of the scrap sliding from the dump truck bed gradually, the entire load fell from the dump truck bed at once. The force of the material leaving the bed caused the dump truck bed to swing back and towards the front end loader. The dump truck bed struck the boom or arms of the front end loader. This caused Employee #1 to be thrown or catapulted from the elevated platform. Employee #1 struck the ground, and suffered head injuries. Employee #1 was killed.
