Employee Fractures Legs When Run-Over by Forklift

At approximately 1:55 p.m. on April 23, 2008, Employee #1 and Employee #2, of RCP Block and Brick, were completing customer orders by using forklifts to pull materials out of the yard and placing them onto trucks. Employee #2 was operating a Cat Forklift truck to pull a pallet of bricks from out of a shed for a customer. Employee #1 came up behind the forklift. Employee #2 looked to his left, and then backed up and turned right. Employee #1 thought that the forklift was going to back straight, but when it turned to the right he couldn't get out of the way in time. The forklift struck Employee #1 in the left leg, with its right rear wheel, and knocked him down as it ran over his foot. He was hospitalized for treatment for fractures to his lower legs.
