Investigation Summary
At approximately 11:35 a.m. on April 14, 2008, an employee was installing a window frame in an opening on the mezzanine level, one and one- half story above the ground. There was a temporary guardrail on the northern perimeter of the mezzanine, but there was an opening on the west end where a temporary barrier had been removed and replaced with red caution tape. The opening at the west end was 98-in. long, the width of the mezzanine floor, and 25-in. wide. Beyond the opening was an exterior wall with steel framing and sheet rock installed, which made it look like the floor went all the way to the wall. The employee and the foreman had finished the work when the employee laid out his extension cord on the mezzanine floor in order to unravel it before putting it away. The employee was laying out the cord while walking backward toward the west end of the mezzanine. The employee walked backward and fell through the unguarded opening. He landed on the concrete deck fifteen feet below. According to the General Contractor, a temporary barrier consisting of a plywood sheet with the red caution tape had been placed in front of the opening the Friday before the accident. The red tape was still across the opening the morning of the accident, but the plywood sheet had been removed. The employee was transported to Scripps Hospital in La Jolla, where he was hospitalized and underwent treatment for a broken back and broken ribs.
