Employee Is Struck and Pinned Between Excavators

On March 8, 2007, Employee #1 was walking beside a parked Caterpillar excavator Model Number 322 BL, while an operator of a Link-Belt Model Number 4300 excavator, was in his cab, preparing to shut it down. The shovel of the Link-Belt excavator was resting on earth, 4 ft away from the right side track of the Caterpillar excavator. As Employee #1 walked between the Caterpillar excavator, and the shovel of the Link-Belt excavator, the operator of the Link-Belt excavator, inadvertently hit the safety gear and left lever that controls the shovel and boom. The shovel rose up from the ground, moved left, and pinned Employee #1 against the track and counterweight of the parked Caterpillar excavator. He sustained two fractured ribs and bruises.
