Employee injured when pneumatic staple gun fires into knee

At approximately 11:00 a.m. on January 7, 2008, Employee #1, who worked for a special trade contractor involved in fence construction, was using a Senco pneumatically-driven staple gun, model SNS45XP. His finger was on the trigger when he bent down and struck his knee against the safety yoke, discharging a 2 in. fastener into his left knee. A coworker used his personal car to drive Employee #1 to Kaiser Permanente in Fontana, CA, where he was hospitalized for two days. The owner/direct supervisor was not at the work site at the time of the injury.
