Employee sustains head injury in fall from ceiling joists

On December 13, 2007, Employee #1, a general construction worker for a site subcontractor, was told by his superintendent to use pieces of 2-by-8 to frame out ceiling joists that had been cut to allow room for a heating, ventilation, and air conditioning (HVAC) system support. Shortly after he had completed the framing work, the pieces gave way, causing Employee #1 to fall over 15 ft onto a cement floor. He sustained severe head trauma that required hospitalization. Employee #1 had been issued a fall protection harness and lanyard by the employer, but he did not have it with him and was not wearing it at the time of the accident. The employer was cited for a violation, general, of T8CCR 1511(b), pre-work site survey to determine predictable hazards; a violation, regulatory, of T8 CCR 342(a) for not reporting a serious injury accident to DOSH within eight hours; and an accident-related violation, serious, of T8CCR 1716.1 (c)(1), structual wood framing; Fall Protection.
