Investigation Summary
At approximately 11:30 a.m. on May 25, 2007, an employee and five coworkers were at a residential construction site. During preparation to pour concrete for stem walls, the workers noticed a dumpster that needed to be moved. The forklift operator, intending to move the dumpster, approached the dumpster, situated near the cement truck. The employee approached the forklift on foot, close enough to touch the forklift with both hands, on the operator's right-hand side, to speak with the operator. As the employee turned to walk away, the forklift operator released the brakes, and then noted the back tire had lifted. The operator looked back to see that the driver's side rear tire was crushing the employee. The employee was killed. The forklift operator had worked a 17-hours day previously.
