Employee Killed When Cart Tips Over

Employee #1, a routine-maintenance worker who had been working for the employer for 7 to 8 years, was operating a utility cart. Apparently the employee was trying to avoid a speed bump located in close proximity to a peninsula curb. Employee #1 was on his way back to the Facilities Maintenance Building located about 400 ft away. Apparently the employee swerved to avoid the speed bump but misjudged the site conditions. His right wheel hit the curb; it went up onto the peninsula and caused the vehicle to tip over. The top rail of the canopy landed on his head causing massive trauma and cranial fractures resulting in death. The utility cart was modified by the employer. The cart was a flat bed cart with a low center of gravity; however, the employer added on a high canopy with the capability of storing ladders on top. The addition of the canopy plus ladders raised the center of gravity causing the vehicle to tip more easily. No supervisor or co workers were present at the time of the accident. A student observed the cart tipping over.
