Investigation Summary
On May 23, 2007, Employee #1, a "Schematic Specialist", or "Set Crew Merchandiser", was asked to set up the "Frozen Food Department" in the market, which was in the final stages of a complete remodel project. At the time of the accident, Employee #1 was working at the "Kosher Frozen Foods" section, towards the back of the store. There was a coworker working in the aisle, who was closer to the front of the store. According to the Employee #1, he started working at 5 a.m. and indicates that he had more than 15 doors of frozen food products to set up in the freezers. The scissor lift was operating in the same aisle, but was at the front of the aisle. Employee #1 indicates that he was not aware that the scissor lift was operating in the area before the accident happened. Employee #1 was putting items in the freezers when the bank of lights suddenly came down and hit him on the head. It drove Employee #1 into the floor, resulting in one part of the lights hit him on the side of his head and his whole body pinned under the light fixture. Employee #1 could not move and it took three or four people to lift the bank of light fixtures off him. Employee #1's injuries included a fractured left hip and head lacerations on the right side. Employee #1 was hospitalized for four days, had stitches on his head and surgery for hip replacement.
