Employee Falls from Tree and Is Killed

At approximately 9:03 a.m. on November 2, 2009, Employee #1 was employed in a gardening business. Employee #1 had taken on a side job outside of the company business. Employee #1 was in the tree at an intersection where two large limbs connected onto the lower trunk. A coworker stated that Employee #1 had not been tied off with any ropes and had not been using a safety belt or harness for fall protection. The coworker stated he had warned Employee #1 against taking on that job and that if he insisted, then he should come back and do that work on his own time. The coworker stated that he was doing other work in the yard, but he believed Employee #1 had finished trimming and was about to come down when he fell. The coworker did not see Employee #1 fall. When Employee #1 fell, he landed on a garden statue which hit him in the right chest area. The Coroner described the resulting blunt force trauma as a preliminary conclusion for cause of death. Employee #1 was pronounced dead at the scene by the Coroner.
