Investigation Summary

At approximately 3:30 p.m. on August 21, 2008, after finishing a job, an employer told his workers to go home and come back on August 25, 2008. Then employer and coworker left the job. However, an employee chose to stay there at his own time to cut a piece from a wood cabinet, which was trashed out by the house owner. The employee wanted to take this cabinet home. The employee used his own skill saw to cut some wood from the cabinet. While he was using this saw, the saw kicked back and the employee cut his left arm. He was working alone outside. Some other workers of a different employer were doing some floor work inside the house at the job site. The employee went inside and asked for help. Other coworkers called for emergency medical services, and the employee was taken to the Stanford hospital, where he was treated and released within three hours. The employee stated that he was doing this job with his own tool and at his own time. The employer did not assign this job. The saw, used by the employee was not available for inspection; however, two coworkers testified that the saw was a Makita skill saw with an adequate guard.
