Investigation Summary
At approximately 9:28 a.m. on July 23, 2008, Employee #1, a carpenter, was working on a high school remodeling project. He was working with a coworker to jack up an interior wood frame wall on the ground floor so that a supporting floor beam could be installed below the wall. The coworker was standing about 2 to 3 ft away, watching as Employee #1 set a 10 penny nail with a hand-held framing hammer and then placed a firm blow upon the nail. Upon impact, the nail ricocheted back out of the wood and toward the employee's face/head. The nail entered just above his left eye and caused damage to the left eye. He sustained three lacerations to his left eye orb; two sealed themselves, one required sutures. Employee #1 was transported to Stanford Hospital, where he was hospitalized. The coworker stated that the employee was not wearing safety glasses at the time of the accident and that the employee pulled the nail out himself. The employer was cited by: 3382(a) Eye and Face Protection. GENERAL At the location the employer failed to ensure that an employee was wearing safety glasses or other eye protection as a safeguard while working in a location where there was a risk of receiving eye injuries such as punctures, abrasions, contusions, or burns as a result of contact with flying particles, hazardous substances, and projections inherent in the work assignment as required by Section 3382.
