Investigation Summary

On May 25, 2006, Employee #1, a restaurant owner, was installing a prefabricated, outdoor, walk-in food cooler at the rear of the building. The cooler measured 9.5 ft tall and 3.58 ft wide with an outer shell. The outer shell had dimensions of 9.75 ft long, 3.83 ft wide and 0.33 ft thick, and walls that comprised of two sheets of aluminum with 2 in. of insulation between them. Employee #1 was assembling the roof as he stood upon the top section that was not fully supported by the exterior walls. He lost his balance or the exterior wall collapsed, causing Employee #1 to fall. He fell 9.5 ft and landed on the concrete, sustaining lacerations on his nose, above his left eye and above his left ear. After the fall, he did not seek medical treatment, until the following day. At the hospital, he underwent a medial evaluation that revealed he had fractures in both arm. Following the evaluation, he received medical treatment for the fractures and was released from the hospital.
