Investigation Summary
On the day of the accident, the foreman assigned Employee #1 and a coworker the job of removing hardened concrete from a storm drain located in a 4-ft 6-in. deep excavation in which the company was to install a sand filter. The two employees were told to use equipment and tools brought to the job site that was in the company owned work truck. The employees got a digging bar and an 8-pound sledge hammer from the back of the truck and proceeded to remove the concrete from the location. Employee #1 held the digging bar with two hands, while the coworker hit the top of it with the sledge hammer to break the concrete lose. The employees stated that during this process the 8-pound head of the sledge hammer came off of the handle while it was being swung and struck Employee #1 in the head and arm. The employees were not wearing head protection at the time of the accident. Employee #1 suffered a mild concussion, abrasions, and a laceration to the head requiring stitches, as well as a contusion on his arm. Employee #1 was treated but not hospitalized.
