Investigation Summary
At approximately 10:15 a.m. on July 28, 2006, Employee #1 of Clark Construction, Incorporated was working at a job site, located near North Butte Rd. and West Butte Rd. in Live Oak, in California. The job site was a rice field also known as the "Live Oak Gun Club". The employees were instructed to move dirt from one area on the property to another area. At the time of the accident, Employee #1 was driving a water truck and the other driver was driving a 1989 Ken worth, semi-truck license Number 9A36951 and LDKG trailer Number 1UA2211 to haul the dirt. The accident occurred, when Employee #1 attempted to get on the semi-truck to relieve the coworker from running the excavator. The coworker was unaware of this plan and did not see Employee #1 trying to enter the truck. As the coworker started moving forward, Employee #1's soft sided lunch pail got stuck in the front passenger-side truck tire, pulling him under the truck and trailer tires. Employee #1's both legs were run over by a semi-truck, but only his left femur was fractured. Employee #1 was hospitalized.
