Employee Is Injured When Struck by Falling Tire Rack

On January 8, 2008, Employee #1, a tire installer directly hired by his employer, was opening up the garage for the day at a retail automobile tire sales and installation business. The establishment consisted of a garage housing approximately five mechanic's bays and an office area. Employee #1 was moving a wheeled, two-tiered tire rack from a bay to the parking area directly outside the bay, where the racks were normally placed while the shop was open. The rack held 14 tires and was approximately five and one-half feet tall by five and one-half feet long. Loaded with tires, the rack weighed approximately 350 pounds. Employee #1 pulled broadside on one of the racks, and the rack fell over. The store manager, Employee #1's direct supervisor, ran outside when he heard the crash made by the falling rack. He discovered Employee #1 on his back, with the fallen rack at his feet and two tires lying on his legs. Employee #1 appeared to be having seizure-like symptoms. Emergency personnel took Employee #1 to the local hospital trauma center, where he was hospitalized for a potential head injury. The accident was reported the same day by responding emergency personnel.
