Employee Is Run over in Fall from Forklift

On February 19, 2007, Employee #1, a brick tender, was working for an employer that was engaged in constructing portions of a new building with stone. Employee #1 was operating a Grad-All forklift truck (Model 534B). Employee #1 was moving supplies and materials from a staging area to the area under construction. Employee #1 stopped and exited the forklift to ask a coworker about a materials pick-up. When Employee #1 got back into the forklift, he tried to start it, but it would not start. After checking the battery, Employee #1 got back in the cab and restarted the forklift when he remembered that he needed to replace a cover on the battery. After Employee #1 replaced the cover, he started to climb into the forklift. Employee #1 slipped and accidentally knocked the machine tilt/level lever when trying to grab something to break his fall. The forklift slowly started forward and the rear tire knocked Employee #1 to the ground, running him over. Employee #1 was hospitalized where he was treated for a crushed pelvis, reconstructive surgery, and gall bladder removal.
