Investigation Summary
On August 30, 2004, an employee, a labor performed hod tending for brick masons on a discrete portion of a new fire station building being constructed. This portion of the structure was called the South Vestibule which was set back into the building from the outside exterior wall. The South Vestibule was temporarily planked to create a walking and working surface for brick layers and materials. Scaffolding were set up on the outside wall perimeter from prior block work and left for future brick work at a later date. The South Vestibule was approximately 19 ft 2 in. above the ground level and scaffolding above that elevation. It is not certain exactly what happened, however the investigation has alleged that the employee was ascending or climbing to reach the South Vestibule work area. The employee fell and landed between the scaffolding and the exterior wall. The employee fell while either climbing scaffolding end frames or making a 30-in. lateral step between the exterior wall and scaffolding and or after reaching top of the concrete wall section in the South Vestibule. No guard rails were utilized to protect workers from falls from the South Vestibule exterior wall section. The employee injured lower back portion of his head when he struck the corner of the concrete footer protruding out from wall at foundation level. The employee was transported to Miami Valley Hospital, where he never regained consciousness and later died from complications on September 3.
