Employee killed when struck by brick wall

On February 23, 2004, Employee #1 and two coworkers, the day laborers, were performing demolition of some concrete wall sections on a renovation project of a single family home. They were working at the side of the home and at the basement level, chipping the walls with 25-lb pneumatic hammers. The coworker was working on a stepladder between the two walls that were to be chipped and removed. Employee #1 bent over on the ground chipping at the base of the wall near the back corner of the building. A 5-ft-by-8-ft section of the brick wall slid off the building from the floor above and landed on Employee #1. The coworkers raced to Employee #1 and removed debris. They laid Employee #1 on his back and then ran to call emergency medical service. The rescue personnel arrived and pronounced Employee #1 dead at the scene. The employer had no knowledge of the requirements of demolition. No evidence was found of any written work rules, training, or any specific directions on how the demolition work should be done. Evidence found that the brick ledge was chipped away, leaving the brick wall unsupported. Also, the lack of brick ties to the house was observed. This could have been easily observed as the demolition progressed.
