Employee Is Injured in Fall Through Floor Opening

At approximately 4:20 p.m. on March 21, 2006, Employee #1 was working on a housing remodeling project that was to add 12 feet to the rear of the house. His crew had been working from the atrium scaffold that did not have guard rails nor planking to cover the 55-inch floor opening between the platform and atrium wall. Employee #1 was working from one detached section of a two-section Werner D1124-2 extension ladder. The section was cut in two, and the severed end of the ladder section was not equipped with any means of slip resistance, such as shoes, spurs, or spikes. Instead, the rail ends were covered in cloth and blue tape, which did not qualify as a safety device of good substantial design. Employee #1 was standing on the ladder with the inappropriate ends at the base of the ladder, resulting in an insecure footing. The ladder slipped, and he fell 25 feet, through the 55-inch platform opening onto the plywood floor. He was hospitalized for 32 days for various broken bones and also required surgery on his patella and the installation of four screws in his vertebrae.
