Employee Is Injured in Fall from Scaffold

On October 1, 2004, Employee #1, a foreman with a construction company specializing in waterproofing of concrete buildings, was working at building being remodeled for a new performing art center. He was using a pry bar and hammer to remove a piece of plywood from a window seal while standing on the second tier of scaffolding. Employee #1 fell approximately 12 ft to the ground in the narrow space between the building and the scaffolding. Employee #1 was hospitalized for abrasions and bruises to his left flank and shin, lacerations to his face and head, bruises to his left shoulder and shoulder blade, a fractured back at the L3-L4 level, and a deep brain hemorrhage (intraparenchymal hemorrhage). Three other crew members were working inside the building on the adjacent windows on the same floor. Neither they nor Employee #1 could explain how Employee #1 fell. The scaffold had been erected in compliance with the applicable standards.
