Employee Is Injured in Fall from Scaffold

The employer is involved in the building of preengineered metal buildings and on-site metal fabrication. On the day of the accident, Employee #1 (the foreman), and two coworkers, were installing trim on metal sheeting and tubing for a shooting range. The employees were screwing on metal trim while working from ladders, or were tied-off with harnesses and lanyards when working from the metal tubing. Employee #1's supervisor stated that the work was to be performed from ladders and that none of the work should have been performed from the scaffold platform. At the time of the accident, Employee #1 moved a scaffold platform to the top of the metal tubing. The scaffold platform was 17 ft above the ground and approximately 9 ft above the horizontal tubing below. The scaffold was not secured to the tubing. As Employee #1 was moving onto the scaffold platform, the platform moved beneath him and he fell into the tubing. Employee #1 suffered a broken right leg, seven broken ribs and a punctured lung, and was hospitalized.
