Investigation Summary
At approximately 11:00 a.m. on August 31, 2005, Employee #1 was working as a painter with Martin Container in Compton, CA, a private incorporated company that paints and modifies steel shipping containers. Employee #1 had been employed at Martin Container for 24 years. Employee #1 was working in the yard of Martin Containers near the company's offices, using a pneumatic spray painting gun to paint a steel storage container 20 feet long by 8 feet wide by 8 feet 6 inches high. To paint the top of the container, he climbed up an eight-foot aluminum step ladder. So that he would not smudge the freshly painted surface, Employee #1 walked backward while painting. When he reached one of the corners of the container, however, he stepped too far and fell off the container to the ground. He sustained a concussion to his head, and he was hospitalized. Two coworkers were working nearby, but they did not witness the incident. It was a common practice to stand on top of the containers while painting them, and Employee #1 had done so for two years. The site foreman, Employee #1's direct supervisor, was on site but not in the area at the time of the incident. A causal factor was that Employee #1 was not properly protected from falling while working at an elevated work location.
