Investigation Summary

On July 10, 2004, Employee #1, tripped over a piece of merchandise and fell, causing a fracture to his leg, This accident was reported by the employer on July 12, 2004. His employer is an automotive dealership of new and used vehicles, as well as an automotive parts and service center. Employee #1 fractured his right femur, requiring 6 days of hospitalization and surgery. Employee #1 was treated at Scripps Hospital in La Jolla, CA. On July 10, 2004, Employee #1 was working alone, and he had set aside a boxed up roof rack for a customer. It was closing time, and the customer never came by to pick up the part. Employee #1 had put the boxed part behind him at the service counter. Employee #1 put a stool next to the 4 by 0.5 foot part as a reminder to go around the part. Employee #1 had walked past the part twice to get stock in the back, but the third time the Employee #1 clipped the part and fell. The fall was not an elevated fall; Employee #1 fell on ground level, but fractured his right femur. Tripping over a part and falling from ground level is usually not enough to break a femur, but Employees #1 previous medical condition contributed to the severity of the injury.
