Employee is injured while operating automatic liftgate

At about 1:45 p.m. on January 29, 2004, Employee #1, a textile services employee, was attempting to operate a Maxon Railift automatic liftgate, Model Number RC-3B that was mounted to the rear of a 26-foot bobtail delivery truck. The steel gate was controlled a steel platform, measuring approximately 42 inches by 90 inches, and had a capacity of 3000 lbs. He completed loading the delivery truck, number 1132, and began operating the liftgate controls. For some reason, he caught his finger in a pinch point of the external hardware. Employee #1 was hospitalized and treated for his injury. An investigation revealed that there were no warning labels or signs on or near the gate controls and the employer could not provide evidence that employees received proper instructions on the hazards of this operation.
