Employee injured when leg pinned by tree being cut down

On May 30, 2003, Employee #1 was cutting down a tree near a residential home when his leg became pinned under the tree. As the tree was falling, it became lodged against another tree and kicked back, pinning Employee #1's leg against an earth side wall of a stairway. The tree base measured approximately 32-inches-to-36-inches in diameter, and the cut was made to the tree approximately 2-feet above the ground. Employee #1 was the sole owner of the company, and was hospitalized for several days for injuries to his lower leg and ankle.
