Employee killed when pinned between van and loading dock

Employee #1 was an independent contractor and carpet installer for this employer. The task at hand was the loading of carpet and padding into Employee #1's son's work van from the company warehouse. Employee #1's son was attempting to back the van into the loading dock. Employee #1 was standing behind the van, off center, and was between the van and the loading dock. Possible causal factors include the drivers failure to properly adjust the vans drivers seat, which had previously been adjusted for a smaller driver, causing him to lose control of the vehicle due to lack of space for free leg movement. In addition, the failure of Employee #1 to stay to the side of the vehicle during the backing maneuver was a factor in the incident. Employee #1's son was backing the van and could not stop the vehicle in time to prevent the van from striking Employee #1, pinning him between the van and the loading dock and fatally injuring him.
