Investigation Summary

At approximately noon on January 3, 2003, Employee # 1 and his coworker were collecting recycling in a residential area. The coworker was driving the truck. Immediately before the accident, both employees had emptied recycling bins into the trailer and exchanged words. The coworker got in the cab and the Employee #1 stood on the passenger side of the trailer on a running board while the coworker drove down the street. At an intersection cardboard blew off the truck. The driver stopped the truck, and both employees loaded the cardboard back into the truck bed. The coworker went back to the driver's seat and Employee #1 again stood on the passenger side running board of the trailer. The driver put the truck in gear and began turning a corner (left turn) at the intersection (downhill). The driver claimed the truck was going very slow and doubts that he had applied the gas. After rounding the corner, the driver heard something fall and looked back. The driver didn't see anything and proceeded a little further and looked back again. This time he saw Employee #1 lying in the street with his head against the curb. The conditions were dry; there were no snow or ice. The driver approached Employee #1, gave assistance, and called emergency services. Employee #1 was killed.
