Investigation Summary
At 1:30 p.m. on May 20, 2005, Employee #1, a carpenter, was framing a residential home that was under construction. The residence was located on the beach and consisted of three tiers, which increased in height at each level and backed away from the water. The first tier went from the sand to the first deck that was 12 feet 4 inches from the ground and was 10-feet deep. The second tier went up an additional 14 feet 6 inches to another deck that was 7-feet deep. The third tier went up an additional 10 feet 10 inches to the roof. Employee #1 was setting roof joists (LVLs) on the top of the home's roof, which consisted of laminated lumber that ran perpendicular to the beach and measured approximately 20 feet by 14 inches. In addition, the joists overhung the edge of the roof by 5 feet. Employee #1 returned from lunch and was located on the roof near the third tier laying out and nailing the joist, when he stepped over the edge onto the overhang of a joist that was not set. The joist shifted, and he fell 38 feet to the ground, striking tiers two and three on the way down. Employee #1 was hospitalized at a local hospital, where he remained for approximately 37 days, and was treated for a traumatic brain injury. Employee #1 was later transferred to Long Beach Memorial Hospital.
