Investigation Summary
On March 24, 2004, Employee #1 and a coworker were constructing a metal storage rack in the warehouse facility. The employer was engaged in the operation of a warehouse and distribution of office products. The racks consisted of sections measuring 8 ft long, 4 ft wide and 6 ft high. At the time of the incident, Employee #1 was constructing the third tier of a four-tier rack, with each tier having a height of 6 ft. He was standing on top of the second tier, about 12 ft above the floor, while trying to place an 8-ft by 4-ft particle board on the third tier above him. Employee #1 lost his balance and fell to the floor, and was struck simultaneously by the falling particle board. Employee #1 suffered a fractured left knee and other multiple fractures in the same leg. He was hospitalized for several weeks, undergoing surgery to repair the damage on his leg. He also spent several weeks in a rehabilitation center.
