Employee Fractures Arm When Pulled Behind Trailer

On September 12, 2003, an employee and a coworker had just finished loading a shipment in their 53-ft trailer and were getting ready to leave. This tractor trailer, Vehicle #1, had been backed into the Stall #5 of the loading dock. The rear doors of Vehicle #1 were wide open and were latched to each side of the trailer. Each of these two doors were about 52-in. wide while total width of the trailer was 102-in. There were two other trailers parked on each side of the Vehicle #1. The doors on Vehicle #1 could not be closed right after the shipment loading was complete, because of its close proximity to the dock and lack of enough clearance on each side because of the other trailers parked on both sides. The coworker told the employee that they would close the doors after he had pulled Vehicle #1 out of the stall. The employee had exited Vehicle #1 to throw away some trash in a nearby dumpster. The coworker pulled Vehicle #1 out of the stall and started to turn right into the parking lot, but he could not make the turn due to a fire hydrant in the parking lot and came to a stop. The coworker looked in his rear view mirrors and did not see anybody on the right side. He could not see the left side rear of his trailer due to its angle. The coworker backed up the vehicle a few feet and stopped. At about the same time, the employee had returned to the rear of the Vehicle #1 and noticed that the vehicle had been pulled out enough and was stopped. The employee unlatched the left side rear door from the side of the trailer and attempted to close it. The door wouldn't completely clear the trailer that was parked in the next stall, so the employee started to pull it back. At the same time Vehicle #1 moved forward again and the rear door pinned the employee's right arm against the side of the parked trailer. The employee screamed for coworker to stop, but he continued forward. When the employee got her arm free, it was ripped open and bleeding. Finally, the coworker noticed the employee collapsed on the ground and he got out of the vehicle and ran into the warehouse to get help. The employee suffered multiple fractures in the right forearm. Surgery was performed to install a metal plate in the forearm. She was hospitalized for a week.
