Employee struck by motorvehicle while setting up cones

On October 23, 2002, Employee #1 and a coworker working for Swank Associated Company were marking cuts in the concrete for expansion joint repairs. The employees were within the appropriately constructed temporary work zone that closed the two outside northbound lanes were performing their job tasks when a motorist heading north veered into the work zone, first striking the orange traffic cone, and then striking Employee #1. The Employee #1 was dragged several yards before falling from the vehicle and striking his head on the pavement. The vehicle stopped several hundred feet from where Employee #1 fell; the driver left the vehicle, looked around, got back into the vehicle, and drove off. Employee #1 died as result of the injuries sustained at the time of the accident.
