Investigation Summary

Investigation Nr: 14225742
Event: 05/29/2001
Employee Struck and Killed By Motor Vehicle on Highway

In an attempt to remove tire debris from an interstate highway, an employee driving a state department of transportation truck (facing southbound, with lights flashing) pulled onto the right shoulder in an effort to cross both the acceleration lane of an entrance ramp and the traffic lanes. As the employee crossed the acceleration lane and was attempting to cross the traffic lanes, the employee was struck by a privately owned vehicle that was also traveling southbound. The employee received life threatening injuries, and died the next day. According to the police and independent eyewitnesses, the victim must have seen the truck, but too late, and attempted to get out of the path of travel. The driver slowed down to approximately 30 mph, but could not avoid the accident. The driver of the privately owned vehicle was not charged.
