Investigation Summary
On February 23, 2001, Employee #1 died when he was crushed between two trucks. A concrete mixer truck driver arrived at a residential construction site to deliver concrete. At the site, another concrete truck from the same company was stuck in the mud. The engine was shut off and no one was in it. The truck driver backed his truck up to the foundation and was dispensing concrete when Employee #1, the driver of the second truck, from the same company arrived in his concrete mixer truck to deliver more concrete. He parked his truck on the street. Employee #1 came to where the other truck driver was dispensing concrete and spoke with him. The concrete finisher asked the other truck driver to move his truck back to the side of the foundation to add some concrete there. To do this, the other truck driver would have to pull up and back between the stuck concrete truck and the foundation. The other truck driver stated he pulled up and before he started backing up he saw Employee #1 about four or five feet in front and to the left of his truck. He said he started backing up using the right and left mirrors. He said he did not see Employee #1 walking to the back of the truck. He stated that at one point he looked in the driver side mirror and saw Employee #1 being caught between his truck and the stuck concrete trucks concrete chute. He said he then pulled forward so Employee #1 could get loose. One other witness observed the incident. He was a concrete finisher. The concrete finisher stated he saw Employee #1 standing about twenty feet behind both the stuck truck and the truck that the other truck driver was backing up. He said right before the incident he saw Employee #1 walking toward the back of the trucks. He said the next time he turned around to look at the truck, Employee #1 was caught between the trucks and killed.
