Employee pinned by the ladder rung died from head injuries

At approximately 11:30 a.m. on October 7,1999, three Employees were in the process of excavating a trench from a developed site to hook up a lateral sewer line to the main line in the middle of the street. The excavator operator had already dug to an approximate depth of 11ft when he felt he contacted the main line with his shovel bucket. At this time, one side of the trench was caving in. He stopped excavating and dropped in a trench box so that an Employee could go down in the trench and hand dig the main line with a shovel. As the Employee got on the ladder that was positioned inside the trench box, the other side of the trench started to cave-in. When the dirt that caved-in contacted the trench box, it caused it to shift laterally towards the side that had initially caved-in. The Employee was pinned by the ladder rung against the exposed concrete road surface. He expired at the scene from traumatic head injuries.
