Employee injured in fall when scaffold plank fails

Employee #1, a mason tender/laborer, was working from the platform of a Mason King adjustable scaffold system. He was undoing a cube of bricks that had just been raised to the platform and was distributing them to the masons to be set into place. Employee #1 was standing on 2 in. by 10 in. planking, which was neither cleated nor otherwise secured, that extended beyond the end support centerline by only 1 3/8 in. at each end. The planking collapsed and Employee #1 fell 19 ft 8 in. to the ground. He suffered a fractured right arm and fractured bones in his back.
